Terms and conditions for using the Dnomia platform

1. Acceptance of Terms

By accessing or using Dnomia, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service. These terms apply to all visitors, users, and others who access or use the service.

2. Service Description

Dnomia is a server-side event tracking and routing platform. The service includes:

  • Server-side event collection, processing, and forwarding to configured destinations (Google Analytics 4, Meta CAPI, Google Ads, TikTok, LinkedIn, Pinterest, Microsoft Ads, and others)
  • SDK for client-side event capture
  • Dashboard for configuration, monitoring, and analytics
  • Data export and privacy compliance tools

3. Account Registration & Access

To use Dnomia, you must create an account. By registering, you agree to the following:

  • You must provide accurate, current, and complete information during registration and keep your account information up to date.
  • You are responsible for safeguarding your account credentials and for all activities that occur under your account.
  • Each account corresponds to one organization. Multiple stores may be created within a single organization.
  • API keys are confidential. You must not share secret keys publicly or with unauthorized parties.
  • You must be at least 18 years of age or an authorized representative of a business entity to create an account.

4. Acceptable Use

You agree NOT to:

  • Use the service for any illegal or unauthorized purpose.
  • Collect data from end users without a proper legal basis, such as consent or legitimate interest.
  • Circumvent or disable consent mechanisms implemented by the platform.
  • Send malicious, fraudulent, or spam data through the service.
  • Attempt to access other users' data or accounts without authorization.
  • Reverse engineer, decompile, or scrape the platform or its components.
  • Exceed rate limits or abuse API endpoints in a manner that degrades the service for other users.
  • Use the service to track individuals without their knowledge where such disclosure is legally required.

5. Data Processing

  • Dnomia acts as a Data Processor under the General Data Protection Regulation (GDPR) and the Turkish Personal Data Protection Law (KVKK).
  • You, the customer, are the Data Controller. You determine the purposes and means of processing personal data.
  • We process data solely on your instructions and for the purposes you configure within the platform.
  • A Data Processing Agreement (DPA) is available upon request by contacting support@dnomia.com.
  • You are responsible for obtaining valid consent from your end users where required by applicable law.

6. Service Availability & Support

  • We aim for high availability but do not guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
  • Scheduled maintenance will be communicated in advance when possible through the dashboard or email notifications.
  • Support is available via the dashboard and email.
  • The free tier includes community support. Paid plans include priority support with faster response times.

7. Fees & Billing

  • A free tier is available with usage limits as described on the pricing page.
  • Paid plans are billed monthly or annually. Payment processing is handled by Paddle.
  • Prices may change with at least 30 days advance notice. You will be notified of any price changes via email.
  • No refunds are provided for partial billing periods.
  • Your access to the service may be suspended if payment is not received within the billing period.

8. Intellectual Property

  • The Dnomia platform, SDK, documentation, and all related materials are the intellectual property of DNOMIA Bilgi Teknolojileri Tic. Ltd. Sti.
  • You retain full ownership of all data you submit to or collect through the service.
  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for the duration of your subscription.
  • You grant us the right to process your data as necessary to provide and improve the service.
  • "DNOMIA" and the DNOMIA logo are registered trademarks. You may not use our trademarks without prior written consent.

9. Limitation of Liability

  • The service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • Our total aggregate liability for any claims related to the service is limited to the amounts you have paid to us in the 12 months preceding the claim.
  • We are not responsible for data loss resulting from your misconfiguration of destinations, event mappings, or other platform settings.
  • We are not liable for failures, outages, or data handling practices of third-party destination APIs (such as Google, Meta, TikTok, or others).

10. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, fire, explosions, civil unrest, wars, epidemics, pandemics, government actions, infrastructure failures, internet outages, or power outages. During such periods, the affected obligations are suspended until the force majeure event ceases.

11. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

12. Termination

  • You may cancel your account at any time through the dashboard settings.
  • We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to maintain payment obligations.
  • Upon termination, your data will be permanently deleted within 30 days. This includes event data, configuration, and account information.
  • Data export is available before termination via the dashboard or API. We recommend exporting your data before canceling your account.

13. Governing Law & Dispute Resolution

  • These terms are governed by and construed in accordance with the laws of the Republic of Turkey.
  • Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of Istanbul Courts and Enforcement Offices.
  • Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good faith negotiation within 30 days of written notice.
  • In any dispute, the books, records, documents, computer records, and fax records of the parties shall be accepted as evidence in accordance with the Civil Procedure Law No. 6100.

14. Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of the service after any changes constitutes your acceptance of the revised terms. Material changes will be communicated via email or through the dashboard. We encourage you to review these terms periodically.
